Why Wills & Estate Planning Matter

Your will is the foundation of a solid estate plan. It makes sure your assets are passed on according to your wishes, helps prevent family disagreements, and gives your loved ones peace of mind. If you don’t have a will, the Queensland Succession Act 1981 decides who inherits — and that may not reflect what you would have wanted.

Briefing our Wills & Estate Planning Lawyers in the Redlands  gives you confidence that your assets are protected, your wishes respected, and the people you care about supported when it matters most.

With modern families, businesses, and tax structures, estate planning has become increasingly complex. Without a will, your life’s work and assets fall into a state formula that rarely reflects your real wishes.
  • Transparent & Supportive Process
With fixed fees, clear timelines, and caring communication, we make what can feel overwhelming simple and reassuring.

Frequently Asked Questions – Wills in Queensland

1. What happens if I die without a will in Queensland?

If you die without a will, your estate is distributed under the Succession Act 1981 (Qld). This intestacy process follows strict rules and may not reflect your wishes.

Probate is a Supreme Court of Queensland order confirming that a will is valid and authorising the executor to administer the estate. It’s often required to access bank accounts, transfer property, or deal with superannuation.

Yes. You can appoint separate attorneys for financial and health matters. You can also appoint multiple attorneys and specify whether they act jointly or independently.

Your will should be stored securely, and your executor should know where to find it. Many people choose to keep wills with their solicitor or with the Queensland Public Trustee for safekeeping.

You can, but excluded family members may be able to contest the will under family provision laws. To reduce risks, we provide advice on structuring your estate plan and including explanatory notes.

Anytime your circumstances change—such as marriage, divorce, having children, buying property, or retirement—you should review and update your will.

Yes. In Queensland, a will must be signed by the testator in front of two witnesses. In some cases, courts may accept an informal will, but this adds complexity and risk.
